Status of Rulemaking
At the Oil and Gas Conservation Commission special meeting on February 18, 2020, the OGCC adopted these rules as temporary to be effective upon adjournment sine die of the 2020 legislative session in the event the Legislature did not approve the rules. The Legislature did not approve the pending rules, and the temporary rules became effective March 20, 2020. The temporary rules were published in a special edition of the Administrative Bulletin in April 2020.
The Department updated the OGCC on the current status of this rulemaking at the August 5, 2020 regular Commission meeting. The Department submitted an appropriate Notice of Proposed Rulemaking for Docket No. 20-0000-2000F which included IDAPA 20.07.02, Rules Governing Conservation of Oil & Natural Gas in the State of Idaho, and it was published as a proposed rule in a special edition of the Administrative Bulletin on September 16, 2020. No changes have been made to the rule that was approved by the OGCC on February 18, 2020.

On October 20, 2020, the OGCC voted to adopt the proposed rule as the pending fee rule for IDAPA 20.07.02. The Notice of Omnibus Rulemaking – Pending Fee Rule was published in the Administrative Bulletin on November 18, 2020.

The 2021 Legislature did not approve the pending rules, and the temporary rules will become effective July 1, 2021. The temporary rules will be published in a special edition of the Administrative Bulletin in July 2021. See the Docket No. 20-0000-2100F page for more information.

The public hearing was held on Wednesday, September 30, 2020 at 9:00am (MT). No oral comments were received on IDAPA 20.07.02. The written public comment period was September 16 through October 7, 2020. No written comments were received on IDAPA 20.07.02. Overview
Rulemaking initiated to ensure the continuity of previously approved administrative rules under IDAPA 20, rules of the Idaho Department of Lands. These rules are necessary to protect the public health, safety, and welfare of the citizens of Idaho and confer a benefit on its citizens. On February 18, 2020, the OGCC adopted IDAPA 20.07.02 as presented in the pending rule docket adopted by the OGCC in September 2019 and submitted to the 2020 Legislative Session.
